概要 The Supreme Court has ruled that a law requiring a person with gender identity disorder to undergo surgery to eliminate reproductive function in order to change the sex on his or her family register is unconstitutional.
The special law governing the sex in the family register of persons with gender identity disorder permits a change of sex only if several requirements are met, including the absence of reproductive function and the appearance of genitalia similar to the sex after the change, which effectively requires surgery.
The Supreme Court focused on three factors in the legislative process. The Supreme Court focused on three factors: changes in legislative facts, developments in medical knowledge, and the laws of other countries. These are the three factors that the Supreme Court, which has long been seen as passive in its constitutional review, is actively deciding.
