概要	This paper aims to consider how we exercise constitutional rights under the rule of law and constitutionalism in Japan. Political parties in Japan belong to state and non-state spheres. Citizens can exercise their constitutional rights such as the right of petition, and freedom of expression to monitor the government. The Freedom of Information Act and the Political Funds Control Act are important for citizens to check and review the government. The government stifles its dissenters and covers up the scandals. The majority would abuse constitutional text to dominate the political process.
